This page explains how Bear Property Management Co., operated by Tomalas Properties, Inc. ("Bear," "we," "us," or "our"), handles your information when you use bearpmc.com (the "Site"), and the terms that govern your use of the Site and our services. By using the Site, you agree to this Privacy Policy and these Terms of Service.

Privacy Policy

We respect your privacy and collect only the information we need to respond to you and manage properties. This section describes what we collect, why, and the choices you have.

Information we collect

We collect information you give us directly, and certain information automatically when you use the Site.

• Information you provide through forms. When you submit our contact form or free rental-analysis request, we collect your name, email address, phone number, property address, and any details you choose to include about your property.
• Owner and tenant portal information. Our owner and tenant portals are hosted by Rentec Direct, a third-party property-management platform. When you create an account, apply for a home, pay rent, or view statements, the information you enter (which may include identification, financial, and payment details) is collected and processed by Rentec Direct under its own privacy policy. We access portal data to manage your account and properties.
• Email correspondence. If you email us or contact us through the Site, we keep your email address and the contents of your message to respond and to maintain our records. We do not currently use a third-party email-marketing platform or send bulk marketing emails.
• Information collected automatically. Like most websites, we automatically collect technical and usage data — IP address, browser type, device information, pages viewed, referring URLs, and similar — through cookies and analytics tools (see Cookies & tracking).

We do not knowingly collect personal information from children under 16. The Site is intended for property owners, prospective tenants, and other adults.

How we use your information

• Respond to your inquiries and prepare your rental analysis;
• Provide, operate, and administer our property-management services and your portal account;
• Process rent payments, applications, and owner disbursements (via Rentec Direct);
• Send you service and account-related messages;
• Measure and improve Site performance and our marketing;
• Comply with legal, tax, licensing, and fair-housing obligations; and
• Detect, prevent, and address fraud, security, or technical issues.

Cookies & tracking technologies

We use cookies and similar technologies to operate the Site, remember preferences, and understand how visitors use our pages. We use Google Analytics, which sets cookies and collects usage data (such as pages viewed and approximate location) to help us measure traffic and improve the Site.

You can control cookies through your browser settings, and you can opt out of Google Analytics using Google's opt-out browser add-on. Some features of the Site may not function properly if you disable cookies.

How we share information

We do not sell your personal information for money. We share information only as needed to run our business:

• Service providers. With vendors who perform services for us — including Rentec Direct (portals, payments), our website host, and Google Analytics — who are permitted to use the information only to provide those services.
• Professional and legal. With professionals such as attorneys, accountants, and insurers, and with authorities when required by law, court order, or to protect our rights, property, or safety.
• Business transfers. In connection with a merger, acquisition, or sale of assets, subject to this Policy.

We retain personal information for as long as needed to provide our services and meet legal, tax, and recordkeeping requirements, then delete or de-identify it. We use reasonable administrative and technical safeguards to protect your information, though no method of transmission or storage is completely secure.

Your California privacy rights

If you are a California resident, the California Consumer Privacy Act, as amended by the CPRA, gives you the right to:

• Know and access the personal information we have collected about you;
• Delete personal information we hold, subject to legal exceptions;
• Correct inaccurate personal information;
• Opt out of any "sale" or "sharing" of personal information (including cross-context behavioral advertising); and
• Non-discrimination for exercising your rights.

To exercise any of these rights, contact us using the details in Contact us. We will verify your request and respond within the timeframes required by law. You may use an authorized agent to submit a request on your behalf.

Terms of Service

These Terms govern your use of the Site. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Our services

Bear Property Management Co. is a residential property-management company operated by Tomalas Properties, Inc., a California licensed real estate brokerage (CA DRE #02222825). The Site provides general information about our services, service areas, and market data. Property-management services are governed by the separate written management agreement you sign with us; nothing on the Site creates a management, agency, or brokerage relationship on its own.

Informational content; no guarantees

Rent ranges, days-to-rent figures, market statistics, neighborhood descriptions, and similar content on the Site are provided for general information only and are estimates based on available data. They are not a guarantee, appraisal, or promise of any specific rent, result, or outcome. The only way to obtain figures specific to your property is a personalized rental analysis. Bear's published guarantees apply only as written in your signed management agreement.

Fair housing

Bear is committed to equal-opportunity housing. We comply with the federal Fair Housing Act and California fair-housing laws and do not discriminate on the basis of race, color, religion, sex, gender, gender identity or expression, sexual orientation, familial status, national origin, ancestry, disability, source of income, military or veteran status, or any other characteristic protected by law.

Acceptable use

You agree not to misuse the Site — including by attempting to gain unauthorized access, interfering with its operation, scraping or harvesting data, transmitting malware, or using the Site for any unlawful purpose.

Third-party links and portals

The Site links to third-party services, including the Rentec Direct owner and tenant portals and our payment and application tools. We do not control those services and are not responsible for their content, security, or practices; your use of them is governed by their own terms and privacy policies.

Intellectual property

The Site and its content — text, graphics, logos, the Bear name and marks, and design — are owned by or licensed to Tomalas Properties, Inc. and are protected by law. You may not copy, reproduce, or reuse them without our written permission, except for your own personal, non-commercial reference.

Disclaimers & limitation of liability

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information is complete or current.

To the fullest extent permitted by law, Tomalas Properties, Inc., Bear Property Management Co., and our owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the Site or any information on it. Nothing in these Terms limits liability that cannot be limited under applicable law.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Site will be resolved in the state or federal courts located in Orange County, California.

Changes to this page

We may update this Privacy Policy and these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be posted on this page, and your continued use of the Site after changes take effect means you accept them.
